1. The process for acquiring Fiji citizenship by naturalisation remains a critical pathway for foreign nationals seeking to make Fiji their home. The process, which is governed by the Citizenship of Fiji Act 2009, has drawn increasing interest from those who have made Fiji home due to business, investment, or family ties. This alert outlines current requirements and offers practical tips for applicants.

Eligibility and Requirements

Under section 11 of the Citizenship of Fiji Act 2009, a person can apply for citizenship by naturalisation if they have been lawfully present in Fiji for a total of at least 5 out of the 10 years immediately preceding the application. For several years, the Department did not allow applications under this category taking the incorrect view that the qualifying period had been increased by the Citizenship of Fiji (Amendment) Act 2020 and later the Citizenship of Fiji (Revised Budget Amendment) Act 2022. However, the Department now accepts applications based on the earlier (and still legally effective) 5 out of 10 years residency requirement.

3. Key conditions include:

  1. intent to reside: an intention to continue living in Fiji
  2. language proficiency: sufficient knowledge of the English language
  3. good character: generally evidenced by a clean criminal record
  4. an oath or affirmation of allegiance to Fiji

Fiji has allowed dual citizenship since 2009.

4. Applications are lodged with the Immigration Department and require the completion of the requisite application form, provision of supporting documents and payment of fees. Processing times can vary, but applicants should expect delays if documentation is incomplete or further verification is needed. If approved, a Certificate of Citizenship is issued, paving the way for a Fijian passport application.

5. To maximize your chances of success, first, verify residency records – ensure your permit history clearly demonstrates the required five-year criteria (time spent as a visitor or student does not count). Secondly, prepare early as collating documents, particularly from offshore, can take time.
